A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The situation originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to face alien smuggling charges, he was detained in immigration custody.
In her decision, the judge noted that the authorities lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
